Australia overtime: do extra hours always have to be paid at overtime rates?

Jez Smith4 October 2026

Not always. Awards and enterprise agreements can set overtime rules, ordinary hours and spreads of hours. Some award-free employees may not have a separate overtime rate, although whether additional hours are reasonable can still depend partly on whether the pay reflects the extra hours.
