Identify the seller, issue and outcome
MIOSA’s guidance starts with the selling or servicing dealer, followed where relevant by the manufacturer’s representative or customer care, then MIOSA. Keep a record of each stage. Do not assume a complaint pauses legal time limits or permits you to stop finance payments.
If the vehicle may be unsafe, ask a qualified technician before driving it. Do not delay seeking help while trying to complete every checklist item. A complaint does not necessarily stop a legal deadline.

Use the official agency or service’s own website to confirm scope, fees and current filing instructions. An investigation, voluntary resolution and enforceable decision are different outcomes.
Motor Industry Ombudsman of South Africa
MIOSA provides an automotive complaint process after the selling or servicing business and relevant manufacturer escalation have not resolved the problem.
Have ready
Its guidance identifies the sales agreement, warranty, service plan, service record and correspondence as useful starting documents.
Important limit
MIOSA assesses the complaint and makes a recommendation. An inspection may be at the consumer’s expense. Check eligibility and do not assume filing stops prescription.
Provincial consumer service
KZN’s department describes a Consumer Protector process that can investigate and mediate complaints, with referral to its Consumer Tribunal where appropriate.
Have ready
Check the provincial service’s current intake instructions and disclose any existing MIOSA or other complaint reference.
Important limit
A provincial enquiry is not an automatic tribunal hearing or compensation award. Ask the service which route fits an automotive complaint.

The Western Cape Government publishes consumer-protection assistance and complaint-contact information for the province.
Have ready
Keep supplier details, contracts, receipts and a short account of attempts to resolve the dispute; check current appointment or submission requirements.
Important limit
Confirm the appropriate automotive route and tell the office about any existing complaint. Provincial assistance does not itself establish a refund entitlement.
Prepare a one-page factual summary
- Transaction: who sold the vehicle, where, when and for how much.
- Problem: what was represented, what happened and when the problem appeared.
- Evidence: number your contract, messages, reports and receipts so each fact can be checked.
- Attempts to resolve: dates, who you contacted, what you asked for and the replies.
- Requested outcome: explain the repair or other remedy you seek without claiming an entitlement you have not checked.
