India Debt Collection & Recovery Problems

First identify who is demanding payment: a bank or NBFC, a recovery agent, another business, an individual, or a court. The applicable protections and response route are not interchangeable.

VISUAL MONEY-CLAIM PATH

Money owed → demand → response → formal recovery.

Use this as a quick map. The detailed rules, deadlines and available remedies still depend on the selected jurisdiction and current official sources.

HOW THIS INFORMATION WAS PREPARED

Jurisdiction first. Official sources first.

GetInstantLaw uses jurisdiction-specific government, court, regulator and primary-law sources first, with JEZ AI used to organise that legal information in plain English. Important facts, eligibility rules and deadlines should be checked against the cited authority before you act.

No lawyer review is implied unless a page expressly identifies a genuine qualified reviewer. Read our Source Standards, Editorial Standards and Corrections Policy.

FIRST SAFETY CHECK

Has formal process started?

  • Creditor and recovery-agent identity
  • Account, agreement and amount claimed
  • Dispute, payment or hardship history
  • Any notice, summons, order or arbitration document
  • Exact receipt or service dates
PRACTICAL SEQUENCE

Organise before escalating

  1. 1Preserve the agreement, statements, invoices and messages.
  2. 2Build a dated payment and communication chronology.
  3. 3Use a factual verification, dispute or demand letter only when appropriate.
  4. 4Stop the ordinary letter sequence if court, tribunal or arbitration papers arrive.

Limitation cannot be guessed from “debt” alone

The Limitation Act contains different schedules and rules, and facts such as the legal basis, accrual date, acknowledgment or part payment may matter. JEZ AI must not present one universal period without analysing the actual claim and current law.

RBI-regulated recovery is a distinct branch

Where an RBI-regulated entity and its recovery agent are involved, RBI fair-practices and grievance requirements may apply. The Reserve Bank - Integrated Ombudsman Scheme, 2026 has applied since 1 July 2026 and replaced the 2021 scheme; complaints continue through RBI CMS after the regulated entity grievance step where applicable. This branch should not be copied to an ordinary private creditor. Threats, impersonation or immediate safety concerns may also require police or qualified assistance.

OFFICIAL INDIAN SOURCES

Check the underlying route

Use the actual document and current State/UT procedure before relying on a deadline, filing method or enforcement step.
