Money Owed and Civil Recovery Claims in India

India has no single universal “small claims” route for every unpaid debt. Court jurisdiction, procedure, fees and limitation depend on the claim, amount, parties, contract, location and State or Union Territory.

VISUAL MONEY-CLAIM PATH

Money owed → demand → response → formal recovery.

Use this as a quick map. The detailed rules, deadlines and available remedies still depend on the selected jurisdiction and current official sources.

1Why is money owed?
2State the amount clearly
3Paid, disputed or ignored?
4Use the correct route

HOW THIS INFORMATION WAS PREPARED

Jurisdiction first. Official sources first.

GetInstantLaw uses jurisdiction-specific government, court, regulator and primary-law sources first, with JEZ AI used to organise that legal information in plain English. Important facts, eligibility rules and deadlines should be checked against the cited authority before you act.

No lawyer review is implied unless a page expressly identifies a genuine qualified reviewer. Read our Source Standards, Editorial Standards and Corrections Policy.

FIRST SAFETY CHECK

Is the debt actually due and provable?

  • Correct legal name and address of each party
  • Contract, invoice or other legal basis
  • Amount due and how it was calculated
  • Due date, acknowledgment and part payments
  • State/UT, venue and limitation facts
PRACTICAL SEQUENCE

Organise before escalating

  1. 1Preserve the agreement, statements, invoices and messages.
  2. 2Build a dated payment and communication chronology.
  3. 3Use a factual verification, dispute or demand letter only when appropriate.
  4. 4Stop the ordinary letter sequence if court, tribunal or arbitration papers arrive.

Limitation cannot be guessed from “debt” alone

The Limitation Act contains different schedules and rules, and facts such as the legal basis, accrual date, acknowledgment or part payment may matter. JEZ AI must not present one universal period without analysing the actual claim and current law.

Settlement and filing are different stages

A demand may help define the dispute, but it does not itself choose the correct court. Lok Adalat can support consensual settlement in suitable matters; civil filing still requires the correct court, territorial and pecuniary jurisdiction, documents, fees and service process.

OFFICIAL INDIAN SOURCES

Check the underlying route

Use the actual document and current State/UT procedure before relying on a deadline, filing method or enforcement step.
