Eight things to gather

Tick an item when you have gathered the records that apply, or established that it does not apply. These ticks are temporary and reset when the page is reloaded; they are not a saved Matter or a claim submission.

0 of 8 items checked

Keep the purchase or lease date, seller name, seller address and vehicle details. Note whether the seller was a dealer or a private individual, and where the transaction took place.

Gather your signed agreement, itemized price, payment receipts, financing paperwork and any trade-in records. Keep the different versions if the paperwork changed.

Save the original listing, screenshots with dates, emails, texts and written promises. Separate what a document says from your recollection of a conversation.

Find the Buyers Guide if supplied, written warranty, service contract and any cancellation or return agreement. Record the dates and mileage shown; do not assume that every purchase has the same return rights.

Collect inspection reports, diagnoses, repair estimates, invoices and dated photos. Record when each problem appeared and the mileage at the time. A photo or AI summary does not establish the cause of a defect.

List purchase, delivery, first problem, each repair visit and each contact with the seller in date order. Mark uncertain dates as uncertain, rather than guessing.

Keep a record of what you asked the business to do, its response and any reference number. Describe the outcome you are seeking without inventing an entitlement or a promise from the seller.

Preserve originals securely. Prepare copies with unnecessary identity and financial details removed for an initial enquiry. If safety, an imminent deadline or a significant loss is involved, seek appropriate professional help promptly.

Our practical checklist is informed by FTC used-car buying guidance and the official services below. It is not a mandatory document list for any agency or court. Completing it does not establish eligibility or pause a deadline.

Dealer conduct, registration or document concerns

California Department of Motor Vehicles

DMV describes the dealer and vehicle-related complaints within its remit. An investigation is not a promise of compensation, and DMV does not handle private-party sale disputes. Check its current instructions and the scope of your issue.

A problem with repair work or a service

California Bureau of Automotive Repair

BAR may help mediate a complaint between a consumer and an auto repair shop when the problem cannot be resolved with the shop. This is a repair-service route, not a general guarantee that a vehicle purchase can be cancelled.

A DATE THAT NEEDS CAREFUL CHECKING

California CARS Act: 1 October 2026

As of our 12 September 2026 source check, California DMV says the California CARS Act takes effect on 1 October 2026. Through 30 September 2026, qualifying used cars below $40,000 remain under the existing two-day contract-cancellation-option framework. From 1 October 2026, DMV says qualifying used vehicles valued at $50,000 or less move to the new three-day cancellation framework.

Do not assume either framework applies to every vehicle, seller or transaction. Check the purchase date, dealer status, vehicle value and current conditions before acting. This checklist does not determine which cancellation rules apply to you.
